In May 2019, plaintiffs proposed a class action lawsuit against Liberty Mutual Insurance Company in a Florida federal district court. The lawsuit alleges that Liberty Mutual underpaid claimants who filed for total vehicle loss claims. The proposed lawsuit alleges that Liberty Mutual has a record of not including fees and payments when paying for total loss claims when a vehicle is “totaled” or not worth the cost of repair. When paying out total loss claims, the plaintiffs allege that Liberty Mutual failed to include local title transfer and state title transfer and vehicle registration fees as part of the payout amount.

The recent proposed class-action lawsuit mentioned above demonstrates how carefully claimants must examine any proposed settlements by Liberty Mutual.
